Supreme Court Affirms Election Of Okowa As Delta Governor

From Delta

The Supreme Court has affirmed the election of Delta State Governor Ifeanyi Okowa.

In a unanimous judgment delivered on Wednesday by Justice Centus Nweze, the court held that the appellant, Mr Great Ogboru failed to prove allegations of over-voting.

He said that the appeal is a waste of the precious time of the Apex Court.

He further added that the decisions of the apex court on the position of card readers are too numerous to begin to mention them or for the appellant to claim they are not in the know.

Governor Ikpeazu Wins At The Supreme Court

The Supreme Court on Wednesday, January 8, 2020 upheld the election of Dr. Okezie Victor Ikpeazu as Governor of Abia State.

A seven-man panel of justices led by Justice Olabode Rhodes-Vivour gave the judgement, Authentic News Giant Learnt.

It would be recalled that Dr Alex Otti of APGA had approached the apex court seeking to be declared Governor of Abia State.

The APGA candidate had previously lost both at the Governorship Election Petitions Tribunal and the Appeal Court.

Counsel to the PDP, Dr. Livy Uzoukwu, SAN, on Wednesday urged the apex court to dismiss the Appeal for want of merit.

Counsel to Governor Ikpeazu, Chief Wole Olanipekun, SAN, supported Dr. Uzoukwu’s call.

“My Lords, this appeal shouldn’t have been before you in the first place. It’s a gross abuse of the processes of this court. My Lords should not hesitate in dismissing this appeal”, he said.

“My Lords, what is before you is a strange appeal and I urge the Court to do the needful and dismiss it”, Olanipekun added.

The Court after listening to the parties announced its judgement.

In the Appeal number marked SC.1465/2019, the Court held that the Appeal by Dr Alex Otti was a waste of time and abuse of court processes.

The apex court subsequently dismissed the appeal for lacking in merit.

Supreme Court Affirms Election Of Governor Ishaku

The supreme court has affirmed the election of Governor Darius Ishaku as Governor of Tarab state.

In a unanimous judgment delivered by Justice Ejembi Ekwo, the court held that the counsel to the APC admitted that the party had no candidate in the election and therefore has no locus standi to contest the election of the governor.

The Judge added that the appellant conceded the fact and went ahead to suggest that the supreme court allow one professor to step into the shoes of the disqualified candidate.

Justice Ekwo held that the law is clear on the issue of disqualification of a candidate.

He held that the replacement sort by APC did not participate in the election and cannot be accorded such value, adding that having resolved all the issues against the appellant the effect of the disqualification is that all the votes cast for that candidate are wasted votes and cannot be scooped from the ‘dustbin’ and given to another.

He concluded that for a petition to be valid it must fulfill all conditions of law which is not in this case.

“This petition is a mere academic exercise and cannot be given any value; and being an abuse of court process, it shall be and is hereby dismissed,” the Judge noted.
