The Supreme Court has struck out an intrigue recorded by Senator Magnus Abe against the stay of execution of the judgment of the Federal High Court, which invalidated the designation of Tonye Cole and others as the hopefuls of the All Progressives Congress (APC) in Rivers State in the 2019 general race

The court, on Monday, maintained the contention by legal counselor to the APC, Lateef Fagbemi (SAN).

Fagbemi had contended that the records of procedures at the lower court, documented by Senator Abe did not pursue the principles of the Appeal Court to guarantee the said archives.

In his judgment, Justice Bode Rhodes-Vivour noticed that just a couple of pages of the records of claim were agreed upon.

Luke, who is counsel for Abe and 42 others, in suit No: CA3/37/2019, said “The appealing party requested a stay of execution of judgment of the government High Court conveyed on Jan. 7. They likewise requested a controlling request.”

“Toward the finish of the procedures today, the Court of Appeal, Port Harcourt Division, conveyed a decision and declined the reliefs limiting INEC from obeying requests of the reliefs that were looked for in the Federal High Court judgment,” he said.

Additionally responding to the decision through his Campaign Organization, the State Governor, Nyesom Wike, said he was not bothered by the choice.

Emma Okah, the representative of the association, said Wike was sure of winning the decision due to his accomplishments in the state.

“We are not bothered. We are not scared of any competitor challenging against Gov. Nyesom Wike.

“His accomplishments in the state will represent him and the general population of Rivers State will most likely give him triumph quickly,” he said.
