Dino Melaye loses in Appeal Court to Smart Adeyemi

 Dino Melaye has once again loss his case against Smart Adeyem, senator representing Kogi West Senatorial District.

The Court of Appeal, Abuja division has affirmed the judgement of the Kogi State National Assembly Election Petition Tribunal, which had on June 10, 2020 on upheld the election of Smart Adeyemi as the senator representing Kogi West Senatorial District.

The judgement of the tribunal was on a petition by former Senator Dino Melaye challenging the declaration of Adeyemi as the winner of the Kogi West Senatorial rerun election.

Justice Kashim Kaigama, leading a 3-man panel had unanimously dismissed the petition by Melaye for lacking in merit.

But not satisfied with the tribunal’s verdict, Melaye headed to the appellate court to seek redress.

In a judgement on Tuesday, the Court of Appeal dismissed Melaye’s appeal for lacking in merit.

The appellate court resolved all the seven issues raised in the appeal against the appellant (Melaye).

The Independent National Electoral Commission (INEC) had declared Adeyemi as the winner of the November 2019 Senatorial rerun election after winning majority of lawful votes cast at the Kogi West senatorial poll.
Adeyemi had polled a total of 88,373 votes to defeat Melaye who scored 62,133 votes at the election.

But, Melaye claimed that the election was marred with irregularities in 564 polling units in the senatorial district where election held.
